Our Agreement With You
These Terms of Use are an agreement between you and Cartwright Realty, LLC, a North Carolina real estate brokerage (NC Firm License No. C29575) ("Cartwright Realty," "we," "us," and "our"). They apply to your use of www.cartwrightrealtync.com (the "Website"). By using the Website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website. When you check a box or click a button to submit information, you agree that it is your electronic signature.
Who We Are
Marissa Christina Cartwright, REALTOR®, is the Broker-in-Charge and owner of Cartwright Realty, LLC (NC License No. 297187). She also owns Staged to Sell, Inc., doing business as Cartwright Decor, a staging and interior design company. Because of this common ownership, Cartwright Realty may benefit when you use Cartwright Decor's services. You are never required to use Cartwright Decor, or any other company we mention, to work with Cartwright Realty.
No Agency Relationship From Using the Website
Using the Website, requesting a report, or contacting us does not, by itself, create a brokerage or agency relationship. Under North Carolina law, a buyer or seller agency relationship is created only by a written agreement. We will review the North Carolina Real Estate Commission's "Working with Real Estate Agents" disclosure with you at first substantial contact. You can read it anytime on the Commission's website.
Listing Information (IDX)
Listing information on the Website comes in part from the Internet Data Exchange (IDX) program of Hive MLS. All information herein has not been verified and is not guaranteed. Listings held by brokerage firms other than Cartwright Realty, LLC are marked with the Hive MLS IDX logo and show the name of the listing firm. Information is deemed reliable but not guaranteed and should be independently verified. Properties are subject to prior sale, change, or withdrawal. Listing data is provided for consumers' personal, non-commercial use and may not be used for any purpose other than to identify properties you may be interested in buying. You may not copy, scrape, resell, or redistribute listing data.
Home Value Estimates Are Not Appraisals
The home value tool gives an automated estimate based on recent comparable sales and the details you provide. It is not an appraisal, a broker price opinion, or a guarantee of what your home will sell for, and it should not be used to get a loan. No Lending, Legal, or Tax Advice
Cartwright Realty, LLC is a real estate brokerage, not a mortgage lender or mortgage broker, and does not make loans. Mortgage rates shown are national weekly averages from the Freddie Mac Primary Mortgage Market Survey® and are not an offer, quote, or commitment to lend. Payment and equity calculators are for illustration only. Information on the Website is general and is not legal, tax, insurance, or financial advice. Please consult a licensed professional for advice about your situation.
Preferred Lenders and Other Providers
We list lenders and other providers for your convenience. You are free to choose any provider. Cartwright Realty receives no fee or other compensation for referrals to the lenders listed. We are not responsible for any provider's products, services, rates, or conduct. You can check any loan officer's license at NMLS Consumer Access.
Fair Housing

We do not discriminate on the basis of race, color, religion, sex (including sexual orientation and gender identity), disability, familial status, national origin, or any other class protected by law.
Your Use of the Website
You agree to use the Website only for lawful, personal purposes, and to give accurate information. You agree not to:
- copy, scrape, or harvest listing data or other content by automated means;
- try to get into password-protected areas, interfere with the Website's security, or overload it;
- submit information about another person without their permission, or submit false or misleading information; or
- use the Website to send spam or anything unlawful, harmful, or offensive.
We may limit or end access for anyone who misuses the Website.
Our Communications With You (TCPA Consent)
Email. When you submit a request on the Website, you agree that we may email you about it. Market update emails are sent only if you choose them, and each one includes an unsubscribe link that takes effect right away.
Calls and texts. We call or text you only if you check the separate, optional consent box on our forms. By checking it, you give your express written consent for Cartwright Realty, LLC and Cartwright Decor (Staged to Sell, Inc.) to call or text you at the number you provided, including with automated technology or prerecorded messages, about your home, real estate services, and staging and design services. Consent is not a condition of receiving a report or buying any property, product, or service. Message and data rates may apply, and frequency varies. Reply STOP to any text to opt out or HELP for help, or tell us by any other reasonable means and we will honor it promptly.
You confirm that you are at least 18 years old, that the phone numbers and email addresses you give us are yours or that you are authorized to use them, and that the information is accurate. More detail is in the "Our Communications With You" section of our Privacy Policy, which is part of these Terms.
Information You Submit
When you request a home value report, a consultation, or other help through the Website, you agree that you are of legal age and able to enter a binding agreement, that the information you give is accurate and complete, and that you are submitting it because you are interested in buying, selling, or owning property. If you already have an exclusive agreement with another real estate agent, please tell us so we can respect that relationship. You are responsible for anything you type into the Website's forms.
Content and Trademarks
The Website's text, articles, guides, photographs, design, and logos belong to Cartwright Realty, LLC, Cartwright Decor, or their licensors, and are protected by copyright and trademark law. Listing photos and descriptions belong to the listing firms or their licensors and are displayed under the Hive MLS IDX program. REALTOR® is a registered collective membership mark of the National Association of REALTORS®. We grant you a limited, personal, non-commercial license to view and print pages of the Website. You may not copy, change, republish, frame, sell, or otherwise use the Website or its content for any commercial purpose without our written permission.
Links to Other Websites
The Website links to other websites, such as lenders, government resources, and Cartwright Decor, for your convenience. A link does not mean we endorse that website, its owner, or its products or services. We do not control and are not responsible for their content, privacy practices, or availability. Any agreement you make with another company is between you and that company.
Some pages may include videos hosted by YouTube. When you watch them, the YouTube Terms of Service also apply.
Disclaimer of Warranties
Information on the Website, such as prices and listing status, can change or be out of date. We share the information we are given and are not responsible for information that is out of date or incorrect. The Website and its content are provided "as is" and "as available." To the fullest extent allowed by law, we make no warranties of any kind, express or implied, about the Website, including about the accuracy, completeness, or availability of listing data, estimates, rates, or other information. We do not promise that the Website will be uninterrupted or error-free.
Limitation of Liability
To the fullest extent allowed by law, Cartwright Realty, LLC, Cartwright Decor, Marissa Cartwright, and the listing firms and data providers whose information appears on the Website will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of, or reliance on, the Website or its content. Nothing in these Terms limits any liability that cannot be limited under North Carolina law, or any duty we owe you under a written brokerage agreement.
Dispute Resolution
Talk to us first. If you have a concern about the Website or these Terms, please contact us first. Most concerns can be resolved quickly. Before starting any formal proceeding, the person bringing the claim must send the other a written description of the claim and allow at least 30 days to resolve it.
Arbitration. If a dispute about the Website, these Terms, or the Privacy Policy is not resolved informally, either you or we may choose to resolve it by binding individual arbitration under the Consumer Arbitration Rules of the American Arbitration Association, instead of in court. The arbitration will take place in Pender County, North Carolina, or by video, or at another location convenient to you. Either party may instead bring an individual claim in small claims court. This section is governed by the Federal Arbitration Act.
Class action waiver. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class or representative proceeding.
Your right to opt out. You may reject this arbitration agreement by sending a written notice to Cartwright Realty, LLC, Attn: Arbitration Opt-Out, PO Box 1224, Hampstead, NC 28443, within 30 days after you first agree to these Terms. Include your name, address, phone number, and the date you agreed.
Not covered. This section does not apply to disputes arising under a written brokerage, listing, or buyer agreement, or a purchase contract. Those disputes are handled under the terms of that agreement and North Carolina law.
Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws rules, except that the arbitration section is governed by the Federal Arbitration Act. Any court case allowed under these Terms will be brought in the state or federal courts located in North Carolina.
Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top shows when they last changed. Changes apply from the date they are posted. Your continued use of the Website after an update means you accept the updated Terms.
General
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and us about the Website.
